Shutdown: It's About Politicians Above The Law


Dear Readers,

This shutdown could have been avoided!

But let's be frank and state what this is really all about, it's about politicians - both Democrat and Republican - wanting to be above the law!

As President Obama, the Democrats, and Republicans like Senator John McCain want to remind us, the Affordable Care Act, also known as ObamaCare, is indeed "The Law of the Land."
Of course, this means that ObamaCare is the law and as such should be funded. But, the problems start there.

It has to do with the law and equality.

In America, under our standards of law, equality under the law is defined as the right to equal protection and equal application of the laws.

Our basic rights and freedoms to which all Americans are entitled, and in whose exercise - our government may not interfere.

This includes the rights to life and liberty as well as freedom of thought and expression and equality before the law. All of this is for every American.

We do not exempt citizens because of their wealth, position, political status. Just as billionaire Bill Gates is held to the same laws as I am, President Barack Hussein Obama is held to the same laws as I am.

Granted both billionaire Gates and millionaire Obama can afford better lawyers, they are governed by the same laws.

This lack of a privileged class, a social upper class, a political class, which is exempted from the law because of their position or status or wealth is at the heart of our Justice System.

No man is above the law, no man is better than the next in the eyes of the law - Justice wears a blindfold and holds the scales of justice while brandishing the sword of retribution just for that reason.

All men are created equal.  Americans understand and respect that!
So why do Politicians feel they are above the Rule of Law?  

The rule of law refers to the authority of law within our society, especially as a constraint upon our behavior, including the behavior of government officials.

In its general sense, "the rule of law" means that every citizen is subject to the law.

It means that no one, including the President of the United States, Senators, and members of the House of Representatives is above the law.

No one has the divine right of a King or Emperor, not here in America.

All government officers of the United States, including the President, the Justices of the Supreme Court, and all members of Congress, pledge first and foremost to uphold the Constitution.

That's right, they take an oath to abide by and uphold the Constitution of the United States.

That oath affirms that the rule of law is superior to the rule of any citizen - even if he is in a leadership position.

The Federal government has considerable discretion:
  • The Judicial Branch has its judicial discretion,
  • The Executive Branch of the president has various discretionary powers including prosecutorial discretion,
  • The Legislative Branch is free to decide what statutes it will write, as long as it stays within its enumerated powers and respects the Constitutionally protected rights of individuals,  
  • But still, none of those people within these branches of government are exempt from the laws governing the United States.
The U.S. Constitution is explicit in its references that all are to obey the law - as its laws are the Law of the Land .

As a nation of laws, our foundation is built around the concept that no man is above the rule of law - and that's why the government is shutdown today October 1st, 2013.

ObamaCare, while it is indeed the law of the land, yet it exempts Politicians who voted for it. 

Because of this, there are Republicans who now refuse to fund a law that applies to some - but not all.

Yes, it is just that simple.

The worse problem with ObamaCare is that those politicians who passed it are exempt from it.

Remember that ObamaCare is the law of the land as Republican John McCain has reminded us many times lately.

But don't forget the inconvenient facts that both Slavery and Prohibition were also the Law of the Land at one time or another - and both were deemed detrimental to the people of the United States.

Because both were found to be detrimental, both are no longer the Law of the Land.

Yes, President Obama personally negotiated an exemption with the Democrats who were in charge of Congress at the time that ObamaCare was put into law.

The Democrats, those in the White House and in control of Congress at the time, exempted themselves from having to follow the law.

This while they will have 75% of their health insurance costs paid by the government.

Yes, Democrats believe so much in ObamaCare that they don't want to part of it and have put themselves above the law - which as a matter of fact is a clear violation of the

An old friend sent me this note:

"As you know I am employed with the FAA. Today I was called and told not to report for duty as the FAA is non-operational. This is all because we have people in office who have forgotten they are there to serve us. We bitch and complain and vote the bastards back in. It shows the mentality of the voters is going down. I am sitting here without pay through no fault of my own. Congress, the House and the President should all be furloughed."

I couldn't agree with her more. She is absolutely right.  Democrats could have avoided this through negotiation and compromise. 

I blame Democrats and Liberal Republicans like John McCain for this because together they fought against any sort of resolution - just so they would not be included as being covered by the new Obamacare law.   

As I see it, because Democrat and some Republicans like John McCain think they are above the law and feel that ObamaCare should not apply to them - this is the result. 

And who suffers? Good hard working Americans like my friend suffer.

She's right, the furlough without pay - or perks - should fall on the President and the entire Congress who are not effected by this.

While this is a fight, not so much about ObamaCare but about those who want to be exempt themselves from the law - I believe that the ones who suffer are not the ones who should be held accountable.

As a nation, we cannot declare classes of men and women to be above others when observing the law. If we do that now, where does it stop.

Do we make it so that they are exempt from other aspects of the law or other laws altogether?

This is a road Americans cannot allow our government to take us. Those in our government must be held to the same laws as the rest of us - laws that they themselves passed!

The Republicans and the Tea Party want everyone to be covered under the same law.

By exempting themselves from the law covering ObamaCare, powerful politicians are essentially saying that they are above the law of the land - and that the U.S. Constitution does not matter.

They are saying that equal application of the law no matter what your wealth, status, position, or political affiliation, does not pertain to them. 

If we let this happen with ObamaCare, where will it stop? We cannot have two sets of laws, one for the powerful and another for us.

The Democrats don't want to negotiate or compromise. They want to be above the law.

Though many are out of work on furlough because of this, we should get behind those in Congress who are fighting to stop this.

We should not let Republicans like John McCain and Democrats like Harry Reid get away with this.

No one should be above the law of the land.

Remember, our politicians work for us. We have power in our vote. 

Theodore Roosevelt said, "A vote is like a rifle; its usefulness depends upon the character of the user."

Some voters have voted to have people like Obama and Reid and Pelosi and McCain return to Washington, I question the character of those people.

Others vote for people who stand against the powerful and wealthy, those self-serving politicians in both parties who seem to spend a lifetime in office - and yes, feel they are above the law.

Look into what your character is made of, and ask yourself who do you support or will vote for in the future?

Will your vote be for the same old bastards and political whores that screw the American people?

Or will it be for people who will stand up against the corruption of politics -  the same corruption that makes some like Obama and Reid and Pelosi believe they don't have to follow laws they pass?

How could we have elected such people into office? How have we put such people in powerful positions to where they feel that they are not governed by the laws they themselves pass?

How did we get to this point?

The Good News is that we can see them for who they are - and we can rid ourselves of them come the next election!

  1. Not all politicians are about the law. Some of them do things that would warrant a resignation. I guess I can describe it the best way I know how. Politics is like a loaded gun. If not handled properly, it's bound to go off.
